1. Acceptance of Terms

By creating an account and using Pactful ("the App", "Service", "we", or "us"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service.

You must be at least 18 years old to use Pactful. By using the Service, you represent and warrant that you meet this age requirement.

2. Description of Service

Pactful is a mobile application that helps users achieve personal goals through accountability pacts. The Service allows you to:

• Create personal commitment pacts (e.g., limiting screen time, building habits)
• Invite friends to endorse your pacts for free
• Endorse friends' pacts to support their goals
• Monitor pact progress through screen time tracking and self-reporting
• Connect with friends for mutual accountability

3. User Accounts and Registration

You must provide accurate, current, and complete information during registration. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Endorsements

Free Endorsements: When you endorse a pact (your own or a friend's), you are providing social support and accountability at no cost. By endorsing a pact, you agree that:

• Endorsements are non-binding commitments to support a friend's goals
• You can accept or decline endorsement requests at any time
• Pactful does not charge any fees for endorsements
• Endorsements are purely for social accountability, not financial stakes

No Financial Obligations: Pactful does not process payments or collect financial stakes. All pacts and endorsements are free to create and participate in.

5. Pacts and User Conduct

Creating Pacts: You are solely responsible for the pacts you create. Pacts must:

• Be legal and not promote harmful behavior
• Have clear, measurable success criteria
• Not violate others' rights or privacy
• Not involve illegal activities, self-harm, or dangerous challenges

Prohibited Activities: You may not:

• Create fraudulent pacts to collect money from friends
• Manipulate or falsify pact data or progress
• Harass, abuse, or defraud other users
• Use the Service for any illegal purpose
• Attempt to circumvent screen time restrictions or monitoring
• Share your account with others

Violations: We reserve the right to remove pacts, suspend endorsements, or terminate accounts that violate these rules.

6. Social Features and Friend Connections

When you connect with friends and endorse their pacts:

• You understand that friend relationships may be affected by pact outcomes
• You agree to communicate respectfully with all users
• You accept that Pactful is not responsible for disputes between friends
• You will not pressure others to endorse your pacts
• Endorsements are voluntary social support without financial consequences

Your Responsibility: Before endorsing a friend's pact, carefully review the terms and duration. We do not mediate personal disputes.

7. Screen Time Monitoring and Permissions

To enforce screen time pacts, you must grant Pactful permission to:

• Access your device's Screen Time data
• Monitor app usage during active pacts
• Receive usage statistics for verification purposes

Data Usage: We only collect screen time data necessary to verify pact compliance. See our Privacy Policy for details on how this data is used and protected.

Accuracy: While we strive for accuracy, screen time tracking may have limitations. You acknowledge that:

• Tracking depends on iOS Screen Time API accuracy
• Technical issues may affect data collection
• You will not dispute pact results due to minor tracking discrepancies

8. User Content and License

You retain ownership of content you submit (pact descriptions, profile information, etc.). However, by posting content, you grant Pactful a worldwide, non-exclusive, royalty-free license to:

• Display your content to your friends and endorsers
• Store and process content to provide the Service
• Show anonymized, aggregated data for analytics

You represent that you own or have rights to all content you submit.

9. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using Pactful, you consent to our data practices as described in the Privacy Policy.

• We collect phone number, name, and screen time data
• We share pact information with friends you've connected with
• We use industry-standard security measures
• We do not sell your personal data to third parties

10. Disclaimers and No Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. PACTFUL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees that pacts will help you achieve your goals
• Accuracy or reliability of screen time tracking
• Uninterrupted or error-free service

Not Professional Advice: Pactful is not a substitute for professional advice. We do not provide:

• Financial, investment, or tax advice
• Medical, health, or mental health advice
• Legal advice or counseling services

Consult appropriate professionals for guidance on personal goals involving health, finances, or legal matters.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PACTFUL SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Damages resulting from disputes between users
• Damages from pact failures or missed goals
• Damages from unauthorized account access
• Any consequences of failed pacts or broken accountability commitments

OUR TOTAL LIABILITY SHALL NOT EXCEED $100.

Some jurisdictions do not allow certain liability limitations, so these may not apply to you.

12. Disputes Between Users

You acknowledge that:

• Pactful is not a party to disputes between users
• We do not mediate disagreements about pact outcomes
• We are not liable for damages from friend disputes
• You release Pactful from claims related to user interactions

If you have a dispute with another user, you must resolve it directly with that person. We may provide account data if legally required, but we do not arbitrate user conflicts.

13. Account Termination

Your Rights: You may close your account at any time through the app settings. Upon termination:

• Active pacts will be marked as cancelled
• Your endorsements will be withdrawn
• We may retain certain data as required by law

Our Rights: We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Harass or abuse other users
• Pose a risk to other users or the Service

We will provide notice when reasonably possible, except in cases of fraud or legal necessity.

14. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by:

• In-app notification
• Email to your registered phone number
• Notice on our website

Continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to changes, you must stop using Pactful.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Dispute Resolution: Any disputes arising from these Terms or the Service shall be resolved through:

1. Good faith negotiation between parties
2. Binding arbitration under the American Arbitration Association rules
3. Small claims court (if eligible)

You waive the right to participate in class action lawsuits against Pactful.

16. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pactful.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

No Waiver: Our failure to enforce any right does not waive that right.

Assignment: You may not assign these Terms. We may assign our rights to any successor or affiliate.
